Student Code of Conduct Policy

  1. Purpose
    1. We all share the responsibility to treat each other, and those who enter the College, with respect and consideration.
    2. The Student Code of Conduct (SCOC) protects and promotes the best interests of the entire College Community by creating a safe and respectful environment where Students can:
      1. Study, learn and work without unreasonable interference or disruption by other members of the College Community.
      2. Be treated in a manner which is civil, respectful, honest, and free from discrimination, harassment, or undue interference with their privacy interests.
  1. Scope
    1. This Policy applies to student behaviour taking place in any physical, on-line environment where the College conducts business as well as behaviour taking place off College sites if such behaviour has the potential to adversely impact the learning and/or working environment of the College. Specifically, it applies to conduct, including on-line conduct, originating on or off campus that occurs:
      1. on any property which is owned or leased by the College or which is related to or being used for College events, activities or processes, including any location where a Student is attending or participating in a College-sponsored activity or event; or
      2. anywhere but is directed at, or directly or foreseeably affects another Student or an Employee or the College itself; and which
      3. violates a rule, requirement or expectation established under the SCOC;
      4. violates civil or criminal laws, where such laws do not adequately protect the College’s interests.
    2. The SCOC Policy will work in conjunction with other College Polices. Where it appears that a concern is outside the scope of this policy or is one that should be more appropriately dealt with under another policy, Act or procedure, the College reserves the right to determine the approach to deal with the concern or refer it to the appropriate forum.
    3. It is understood that any findings or decision made under the Sexual Violence Policy may automatically be within the jurisdiction of the SCOC and any sanctions or remedies will be delivered under the SCOC and are also subject to the right to student appeal through the Student Appeals Policy.
  1. Definitions
Term Definition
Student Anyone applying to or registered in College programs, and participating in College courses, programs, events and activities.
Employee An individual who is currently employed with NSCC to perform work for the College. This includes all employees, regardless of status, as well as current employees who are on a leave of absence (paid/unpaid).
Civility Behaviours that are courteous and polite. Civility and respect are based on showing esteem, care and consideration for others and acknowledging their dignity.
College Community

NSCC Community Member under this policy / procedure includes, but is not limited to the following:

  1. Employee: any person who is currently employed by NSCC or provides services to NSCC under an employment contract. This includes all employees, regardless of status, as well as current employees who are on a leave of absence (paid/unpaid).
  2. Student: anyone registered in College programs or otherwise participating in College courses, programs, events and activities.
  3. Volunteer: any person performing work for NSCC in an unpaid capacity.
  4. Contractor: any individual or company (and its employees) who provides services to NSCC under a service contract (i.e. a non-employee-employer-relationship).
  5. NSCC Community Member: any person working in collaboration with NSCC for a business or academic purpose or an external community member, including all graduates and alumni of NSCC.
  6. NSCC Board of Governors: the governing body of the College.
Resolution Options Refers to a wide range of options to enable and support community members to resolve concerns or conflict housed under the Respectful Community Policy and procedures.
Respectful Behaviour Showing thoughtfulness, consideration, and care toward others in all interactions, recognizing the value in each person, and treating others with fairness and dignity. Includes an absence of offensive behaviour(s).
Restorative Practice Restorative practices are used to foster a respectful learning and working environment by strengthening relationships between people and the community they share. Restorative practices include processes to proactively build relationships and a sense of community to help prevent conflict and concerns. Restorative practices are also used to respond to conflict and concerns by seeking to repair harm and restore the relationships and community affected.
Student Misconduct Includes any breach of the Student Code of Conduct Policy (Examples in Appendix 1).
  1. Policy
    1. Conduct Policies and Behavioural Expectations
      1. The SCOC is part of a suite of College policies and procedures that are in place to ensure that the College Community has a shared understanding and commitment to of the standards of behaviour required of Students. Students are expected and encouraged to become familiar with College policies and expectations.
      2. NSCC is committed to enabling early communication, education and awareness of expected behaviours as well as unacceptable behaviours and the shared responsibility of students and employees to maintain a positive, respectful and civil community.
      3. These policies and procedures (see Policy Supports Section for a list of related Policies and Procedures) address conduct involving mutual respect, disruptive behaviour, academic integrity and honesty, discrimination, harassment, sexual harassment, bullying, physical and psychological safety, property damage, nicotine, alcohol, cannabis and other and substance use.
      4. Collectively, these policies require Students to (Appendix 1):
        1. Demonstrate Citizenship through compliance with the law and with all NSCC Policies.
        2. Act with Civility by behaving in a manner that is respectful of other members of the College Community and refraining from any intentional or reckless conduct, which unreasonably interferes with or disrupts other members of the College Community or campus or classroom activities.
        3. Act with Honesty and Integrity by being honest in the performance of their work andin their dealings with other members of the College Community.
        4. Refrain from Negative or Harmful Interpersonal Interactions by being respectful of the physical, emotional and mental wellbeing of other members of the College Community and by avoiding harassing, abusive, malicious,
          intimidating or defamatory conduct or comments.
        5. Refrain from substance Misuse/Abuse while engaged in NSCC class, Campus and College activities.
        6. Respect Property including property of the College, other members of the College Community, or third parties.
        7. Refrain from Inappropriate On-line and Electronic Activity including Social Media activities.
      5. It is the responsibility of all Students and Employees to be aware of and comply with the standards of behaviour required by the SCOC.
    2. Addressing Concerns
      1. NSCC is committed to providing collaborative, efficient, clear and timely approaches for dealing with concerns that arise out of this Policy. A premise of healing and growth will direct responses and sanctions, whereby sanctions will underscore and develop a responsibility to the collective College community. Learning activities that support engagement with others are promoted wherever possible.
      2. Where a breach of this Policy is established, Student interventions and sanctions will be imposed, depending on the nature of the incident and any past infractions of the Policy. Sanctions are intended to uphold College values and to help individuals understand the impact of their behaviour. Human Rights and Equity, Student Affairs employees may be consulted or engaged to support decision making regarding appropriate sanctions.
      3. The College can impose a range of sanctions if a violation is determined. These may include,but are not limited to:
        1. Conversation about the harmful behaviour with an aim to establish a mutual understanding of expected behaviours.
        2. Referrals to student development programming and services to address issues leading to the violation.
        3. Participation in resolution options aimed at seeking to repair harm and restore the relationships and community affected.
        4. Written documentation of the Student misconduct on the Student file.
        5. Written warning stating expectations of Student conduct and the consequences of further unacceptable behaviour.
        6. Restricted College privileges (for example: restricted computer privileges).
        7. Fines or charges to cover any damaged or unreturned property.
        8. Withholding credentials.
        9. Suspension (ranging from one to five business days). Students who have been asked to leave a campus location will not be able to return to that location until the matter has been resolved.
        10. Dismissal from the College.
        11. A temporary or permanent ban from applying for admission to the College.
      4. In cases where a Student may be subject to civil or criminal proceedings, the College has the right to apply the SCOC simultaneously with, or following, civil or criminal proceedings.
      5. When there is a potential threat to the safety of any member of the College Community; and/or when the continued presence of a Student on campus constitutes a significant disruption to the College, the Campus Principal or Director of Student Services and/or their designate may act unilaterally and impose an interim suspension on a Student. In these situations, the Student will be required to remain off campus pending the conclusion of an investigation and a final decision is reached.
      6. NSCC recognizes student behaviour may be a result of a medical or mental health condition. This will require an approach that considers the health needs of the students as well as safety and wellbeing of the College Community. Actions may include referring the student to community health services to have them assessed regarding their capacity to participate. The assessment outcome may result in a need for accommodation and student supports or a medical withdrawal.
    3. Appeals
      1. Students have the right to appeal if they disagree with a decision if there has been a breach or sanction imposed. The grounds for an appeal are limited to those set out in the Student Appeals Policy.
